Gaviti Pay Terms & Conditions

By agreeing to the terms of this ACH Authorization (“Authorization”), you authorize Paramount Bank and our partners and service providers (“we,” “us,” and “our”) to electronically debit the deposit account you designate in [the Customer-Facing Payer Portal] (“Deposit Account”) in the amount set forth [on the applicable invoice you have received/selected for payment] on or after the date you submit payment [through the Customer-Facing Payer Portal]. You also authorize us to initiate any debit or credit entries to the Deposit Account in order to correct any errors [or provide refunds].

You represent and warrant that: you have all necessary right, power, and authority to authorize us to electronically debit and credit the Deposit Account; you will provide us with complete and accurate information regarding the Deposit Account; instructions that you provide to us in relation to the ACH transfer are complete and accurate; the Deposit Account is a business demand deposit account held by a U.S. financial institution and is used solely for lawful business purposes; and the Deposit Account is not a personal account and is not used for any personal, family, or household purpose. If the Deposit Account is a joint account, you represent and warrant that you have the authority to enter into this Authorization independently and you will indemnify and hold us harmless from any claims by any other owner of the Deposit Account.

You agree that the ACH transactions you have authorized hereunder comply with all applicable law and the rules of the National Automated Clearing House Association (dba “Nacha”).

You are responsible for any fees charged by your financial institution for rejected payment withdrawal requests and insufficient funds. We are not responsible for any overdraft fees, over-the-limit fees, insufficient or non-sufficient fund charges, or any other charges related to the Deposit Account. If an ACH debit transaction is rejected for any reason, you understand that we may, at our discretion, attempt to debit the Deposit Account again until the transaction is completed.

We are not responsible for payment delays that may occur as a result of weekends or holidays, the processing schedule of your financial institution, or other events beyond our control.
